Terms and Conditions

Purpose

These terms govern the sale of collectible trading cards (One Piece, Pokémon and others) as well as new sealed products (displays, boxes), purchased in Japan or from official distributors in France depending on the product, and shipped to our customers.

Order and payment

Each order can be paid in full, or via a deposit followed by a balance. The deposit matches the estimated purchase cost of the product (in Japan or from our distributor in France, depending on the product); the balance (shipping and margin) is requested once the product has actually been purchased.

Non-refundable deposit if balance unpaid

If the balance is not paid within the stated deadline after being requested, the order is cancelled and the deposit is forfeited, as the product has already been purchased on the customer's behalf.

Delivery time

For a card available immediately, the estimated delivery time is 10 to 15 business days after full payment, including purchase in Japan, receipt and reshipping to the delivery address. For a sealed-product preorder, shipment takes place after receipt of stock from our distributor, with the exact timeframe stated in each article's description. These are estimates, not contractual commitments.

Preorders

An item listed as a preorder is not in stock at the time of purchase; it is purchased on the customer's behalf once the stock is received by our supplier or distributor. The delivery estimate in the item description is indicative, depends on our supplier's or the publisher's own timelines, and may change; we cannot be held responsible for delays caused by these third parties. Exceeding this estimate does not, by itself, entitle the customer to cancellation or a refund. Under French consumer law (articles L216-1 to L216-3 of the Code de la consommation), if the delay becomes abnormally excessive, the customer may formally request delivery within a reasonable additional period; failing that, the customer may cancel in writing and receive a refund within 14 days.

Right of withdrawal

Under French consumer law, you have 14 days from receipt of your order to notify us of your withdrawal, plus a further 14 days to return the item. Return shipping costs are your responsibility, except in case of our error or a defective item. An unsealed item or one with damaged packaging may be subject to a deduction from the refund, proportional to the depreciation observed. The refund, including standard shipping fees, is issued within 14 days of receiving the return or proof of shipment.

Lost or damaged parcel during transport

Under Article L216-1 of the French Consumer Code, responsibility for transport transfers to you only once the parcel is physically handed over. In case of loss or damage during shipping, we will refund or resend your order. If the parcel arrives visibly damaged, you must refuse it or clearly note the damage on the delivery receipt before signing: an unqualified signature is considered acceptance of the parcel as is and may affect how your case is handled. Keep the packaging and take photos of the item and parcel before contacting us at promocardsjapan@gmail.com.

Legal guarantees

Every item is covered by the French legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code), which entitle you to a free repair, replacement or refund of a defective or non-conforming product. These guarantees can be exercised by writing to promocardsjapan@gmail.com, independently of any commercial warranty.

Consumer mediation

In accordance with Articles L616-1 et seq. of the French Consumer Code, if a dispute cannot be resolved directly with our customer service (promocardsjapan@gmail.com), the consumer may refer it free of charge to our designated consumer mediator: CM2C (Centre de Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net.

Governing law and disputes

These terms are governed by French law. Failing an amicable agreement or resolution through mediation, the matter will be brought before the competent French courts.
